This Temporary Lease will be used to reserve your below listed property and will become an extension of your formal lease when you arrive in Big Rapids, MI.
IT IS HEREBY AGREED that Lessor does lease the following premise: __________________________________________ Big Rapids MI 49307
to: ______________________________________________________________________________________________________________________________
hereafter called Lessee; For the term beginning the 15th day of ____________________, 20_____ and ending the 15th day of ____________________, 20______, said premises to be used for private residential purposes only. The Lessees agree to be "Jointly and Severally" responsible for the term and the conditions of this lease.
LESSEE AGREES AS FOLLOWS:
1. To pay to the Lessor as rent $_______________ per month in advance on________________, 15th , 20______ and the same amount on the 15th day of each succeeding month during the term of the Lease. If rent is paid after the 20th of the month a $20.00 late fee shall be charged. If paid in advance for the whole semester, rent shall be discounted $50.00 for each tenant who prepays. (Formula: Monthly Rent x 4.5 months = Semester Rent - $50 discount = Total Due.)
2. That _________ people will reside in the premises and understands that should more than _________ people occupy the premises the Lessor shall have the right to terminate this Lease upon seven days written notice.
3. That the premises will not be used in such manner as to generate noise which will disturb other tenants or neighbors nor will other tenants or neighbors be harassed or bothered in any manner.
LESSOR AGREES AS FOLLOWS:
1. That upon timely payment of the rents due by Lessee and Lessee's performance of his/her obligation under this Lease, Lessee shall have peaceful and quiet use of the premise during the term of this Lease.
2. In the event of a happening which makes the above described premises untenable, the Lessor shall have the option to declare the Lease void and of no further force or effect; or Lessor may repair the premises and the obligation of the Lease shall continue to be binding upon the Lessee from the date of completion.
IT IS MUTUALLY AGREED AS FOLLOWS:
1. Upon arrival to your leased premise the following items will be addressed and become an extension to this lease: Formal Lease, Maintenance Agreement, Move-In Inspection,
Lead Paint Disclosure, Smoke Detector Agreement, and other specific needs and/or agreements.
2. Utilites ar not included in the rent, however, upon arrival this will be negotiated out on the formal lease.
3. Lessor acknowledges receipt of $ (To be posted on lease effective date), as a security deposit for the performance by Lessee. Lessor may use, apply or retain the whole or any part of this security deposit to the extent required for the payment of any rent and additional rent or any other sum which the Lessee is in default for any sum which the Lessor may expend or may be required to expend by reason of Lessees default in respect to any of the terms of this Lease, including but not limited to, any damage beyond ordinary wear and tear, to the premises or its fixtures or appliances, and the Lessor may apply as much of said security deposit as necessary for the repair, replacement, or painting of the premises or its fixtures or appliances if such damage was caused by Lessee. Lessee shall have no right to demand that Lessor use any part of this security deposit with respect to any particular violation or default of Lessee, and the use and application thereof by Lessor shall at all times be discretionary. The appropriation of all or part of this security deposit shall not be the exclusive remedy for Lessor, but shall be cumulative, and, in addition to any other remedy to which Lessor is entitled thereunder. In the event that Lessee shall comply with all the terms of Lease, at the expiration of the term hereof, the security deposit shall be returned to Lessee within 30 days after the premises have been vacated and inspected by Lessor. No interest shall accrue to Lessee on any such deposit, and Lessor may commingle the security deposit with the security deposits of other Lessees. Your security deposit is held by Isabella Bank & Trust . The security deposit shall not, under any circumstances, be applied by Lessee for payment of the final month's rent or any other rent or obligation of Lessee under this Lease. In the event of a sale or Lease of the premises, Lessor shall have the right to transfer the security deposit to the vender or Lessee requiring such party to assume the responsibility for the return of same. Lessee shall thereupon look solely to the new landlord for the return of said security deposit. Lessee shall not assign or encumber the money deposit as security.
4. Lessor acknowledges the receipt of $100.00 for 1 and 2 bedrooms, $150.00 for a 3 bedroom and $200.00 for 4+ bedrooms as a non-refundable floor & preparation cleaning fee.
NOTICE: "MICHIGAN LAW ESTABLISHES RIGHTS AND OBLIGATIONS FOR PARTIES TO RENTAL AGREEMENTS. THIS AGREEMENT IS REQUIRED TO COMPLY WITH THE TRUTH-IN-RENTING ACT. IF YOU HAVE A QUESTION ABOUT THE INTERPRETATION OF LEGALITY OF A PROVISION OF THIS AGREEMENT YOU MAY WANT TO SEEK ASSISTANCE FROM A LAWYER OR OTHER QUALIFIED PERSON."
FAIR CREDIT REPORTING ACT NOTICE: A routine inquiry may be made which will provide applicable information concerning character, general reputation, personal characteristics and mode of living. Upon written request, additional information as to the nature and scope of the report, if one is made will be provided. Lessee hereby authorizes Craig Chapman and or associates to make any necessary inquiries concerning my background for rental use of property, which may include obtaining an investigative consumer report. The information obtained may be through interviews with friends, neighbors, or associates. Upon lessee's request, the consumer reporting agency involved will allow visual disclosure and provide you with copies of any such investigative consumer reports and other information in its files.
"YOU MUST NOTIFY YOUR LANDLORD IN WRITING WITHIN 4 DAYS AFTER YOU MOVE OF A FORWARDING ADDRESS WHERE YOU CAN BE REACHED AND WHERE YOU WILL RECEIVE MAIL; OTHERWISE YOUR LANDLORD SHALL BE RELIEVED OF SENDING YOU AN ITEMIZED LIST OF DAMAGES AND THE PENALTIES ADHERENT TO THAT FAILURE."
